Terms & Conditions

1. THE LOCAL GUYS – SERVICES LIMITED NZBN 9429 051 214 425 trading as The Local Guys Pest Control agrees to supply a Residential & Commercial Pest Control Inspection and Treatment (the “Service”) at the specified areas of the premises described above for the Fees (incl GST) in relation to those Pests described in this document in accordance with these terms and conditions. Customer’s furniture and equipment is excluded unless referenced in this agreement for inspection and/or treatment. Additional areas or pests will be subject to a separate survey and proposal.

2. Acceptance

Upon acceptance of these terms, the Customer agrees to abide by the terms and conditions outlined herein. By confirming acceptance via email, or allowing The Local Guys Pest Control to perform the Service, the Customer acknowledges and agrees to be bound by the terms set forth. The Customer also understands that any changes or modifications to these terms must be agreed upon in writing by both parties. By proceeding with the Service, the Customer signifies their understanding and acceptance of these terms and conditions.

3. Fees and Payment

If the Customer fails to make payment of the Fees on the day the Service is rendered, The Local Guys Pest Control reserves the right to charge a late payment fee or suspend future services until payment is received. In the event of a dispute regarding the Fees, the Customer must notify The Local Guys Pest Control within 7 days of receiving the tax invoice. Failure to notify within this timeframe will be deemed as acceptance of the Fees charged. The Customer is responsible for any additional costs incurred by The Local Guys Pest Control in recovering outstanding Fees, including but not limited to legal fees and collection agency fees.

4. Treatment effectiveness

It is important for the Customer to understand that consistent cooperation and communication between both parties are essential to ensure the long-term effectiveness of the pest control treatment. The Local Guys Pest Control may provide follow-up visits or recommendations to maintain a pest-free environment, and it is the responsibility of the Customer to adhere to these guidelines. Any concerns or issues regarding the pest control service should be promptly addressed and communicated to The Local Guys Pest Control for timely resolution. By working together, both parties can ensure a successful and lasting pest control solution for the property.

5. Pest Inspection and Treatment

The pest treatment carried out by The Local Guys Pest Control will be performed using industry-approved methods and products to effectively target and eliminate the identified pests. The treatment plan will be tailored to address the specific pest issues identified during the inspection, with a focus on providing a comprehensive solution to eradicate the pests and prevent future infestations. Customers are encouraged to follow any post-treatment recommendations provided by the technician to ensure the effectiveness and longevity of the pest control measures implemented.

6. Advice and recommendations

In addition to the advice and recommendations provided by the Local Guys Pest Control technician, it is important for the Customer to be proactive in maintaining a pest-free environment. Regularly inspecting and cleaning areas where pests are likely to thrive, such as kitchens, bathrooms, and storage areas, can help prevent infestations. Sealing cracks and crevices in walls, floors, and windows can also help to eliminate entry points for pests. Properly storing food in airtight containers and promptly fixing any leaks or moisture issues can further deter pests from taking up residence in the home. By following these simple guidelines in conjunction with the advice from the technician, the Customer can effectively control and minimise pests in their living space.

7. Access and Safety

The Customer is responsible for ensuring that any pets or children are kept away from the areas where The Local Guys Pest Control personnel are working to prevent any accidents or disruptions. The Customer must inform The Local Guys Pest Control of any specific health or safety concerns related to the premises, such as allergies to certain chemicals or any other relevant medical conditions. It is important for both parties to communicate openly and effectively to ensure a safe and successful pest control service.

8. Customer Co-operation

It is essential for the Customer to ensure that any pets or children are kept away from treated areas as per the instructions provided by The Local Guys Pest Control. In addition, the Customer should also follow any post-treatment guidelines to maximise the effectiveness of the service and ensure the safety of all individuals on the premises. Failure to comply with these instructions may result in reduced efficacy of the pest control treatment and potential risks to health and safety. The cooperation of the Customer is crucial in achieving the desired outcomes of the pest control service.

9. Damage to Utilities

The Customer is responsible for ensuring that all utility services are clearly marked and identified prior to the commencement of any drilling or cutting activities by The Local Guys Pest Control. It is important that the Customer provides accurate information regarding the location of water and drainage pipes, electrical and telephone cables, gas pipes, or any other utilities that may be present on the property. The Local Guys Pest Control will make every effort to exercise caution and prevent damage to these services, but ultimate responsibility lies with the Customer to avoid any potential risks or damages during the service delivery process. Failure to identify and protect utility services may result in additional costs or disruptions that the Customer will be responsible for.

10. Reliance on Service and Report

Any unauthorised use, distribution, or reliance on the reports provided by The Local Guys Pest Control by any party other than the Customer named in the report is strictly prohibited. The information contained in the reports is confidential and intended solely for the benefit and use of the Customer. Any attempt to assign, transfer, or share the reports with third parties without the explicit written consent of The Local Guys Pest Control is a violation of this agreement and may result in legal action. It is imperative that all parties involved respect the confidentiality and exclusivity of the reports provided by The Local Guys Pest Control.

11. Indemnity

The Customer agrees to hold harmless and indemnify The Local Guys Pest Control and its Personnel from any and all liabilities, damages, losses, expenses, and costs, including but not limited to legal fees, arising from any breach of this indemnity provision. The Customer acknowledges that they are solely responsible for ensuring that any third party who obtains the service or inspection report from them complies with the terms and conditions set forth by The Local Guys Pest Control. Any unauthorised distribution or use of the report will be at the Customer’s own risk and may result in legal action being taken by The Local Guys Pest Control to protect their rights and interests.

12. Force Majeure

Force majeure events include, but are not limited to, natural disasters, war, terrorism, government actions, labor disputes, and equipment or system failures. In the event of a force majeure event, The Local Guys Pest Control will make every effort to resume services as soon as it is reasonably possible. Clients will be notified promptly of any delays or disruptions and will be kept informed of the steps being taken to mitigate the impact of the force majeure event. The Local Guys Pest Control will not be held liable for any damages or losses resulting from a force majeure event beyond its control.

13. Bribery

In addition to the prohibition on bribery, both parties also agree to maintain accurate and transparent records relating to the services provided under this agreement. The Customer and The Local Guys Pest Control will ensure that all financial transactions and communications are properly documented and can be made available for inspection upon request by either party or relevant authorities. Any discrepancies or irregularities in the records will be promptly investigated and addressed in accordance with applicable laws and regulations. Failure to maintain accurate records may result in termination of this agreement and potential legal consequences.

14. Debt Collection

In the event that the Customer fails to settle their outstanding debts within the agreed upon timeframe, The Local Guys Pest Control reserves the right to take necessary actions to recover the amount owed. This may include engaging the services of debt collection agencies or pursuing legal action. The Customer acknowledges and agrees that any costs, fees, or charges incurred during the debt recovery process will be the sole responsibility of the Customer. By entering into this agreement, the Customer agrees to indemnify and hold harmless The Local Guys Pest Control from any and all expenses related to debt collection efforts.

15. The Customer acknowledges and agrees that by providing their personal information and consenting to the credit reporting activities outlined above, they are enabling The Local Guys Pest Control to make informed decisions regarding the provision of credit and to assess the Customer’s creditworthiness. The Customer further understands that the information shared may be used by credit-reporting agencies and other credit providers to assess their credit standing and eligibility for credit products. It is important for the Customer to ensure that the information provided is accurate and up-to-date to facilitate a smooth credit assessment process and to maintain a positive credit profile.

16. Entire Agreement

The parties acknowledge that any changes or modifications to this agreement must be made in writing and signed by both parties to be considered valid. Any waiver or failure to enforce any provision of this agreement shall not be deemed a waiver of any subsequent breach or default. The terms and conditions of this agreement shall be binding upon the parties, their successors, and assigns.

17. Liability

The limitations of liability set forth in this agreement shall apply to all actions, claims, or disputes arising out of or related to the services provided by The Local Guys Pest Control, regardless of the legal theory under which such actions, claims, or disputes may be brought. The Customer acknowledges and agrees that these limitations of liability are reasonable and necessary in order for The Local Guys Pest Control to provide its services at a competitive rate. The Customer further agrees to indemnify and hold harmless The Local Guys Pest Control from any claims, damages, or liabilities that may arise from the Customer’s breach of this agreement or misuse of the services provided.

18. General

Any notices or communications required or permitted under this agreement shall be in writing and delivered to the addresses specified in this agreement, or to such other addresses as the parties may designate in writing. Notices shall be deemed given when received or, if delivery is refused, when delivery is attempted. Any communication sent by electronic mail shall be deemed received on the next business day following the date of transmission.
